CarpoolQR Terms of Use

These Terms of Use ("Terms") govern your access to and use of the CarpoolQR website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. What CarpoolQR is (and is not)

CarpoolQR is a technology platform that helps people discover others who plan to arrive at the same parking area around the same time. CarpoolQR does not provide transportation, chauffeuring, dispatch, insurance, or payment for ride services. CarpoolQR is not a party to any ride, carpool, pickup arrangement, or in-person meeting between users.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law. You are responsible for complying with workplace policies, local traffic laws, and licensing rules that apply to you.

3. Accounts and accuracy

You agree to provide accurate registration information (including postal / ZIP for approximate area matching) and to keep it updated. You are responsible for activity under your account.

4. Assumption of risk

Meeting strangers or coworkers for carpools involves risk. You use the Service and any resulting arrangements entirely at your own risk. You are solely responsible for evaluating other users, vehicles, routes, weather, and safety.

5. Release and limitation of liability

To the maximum extent permitted by law, CarpoolQR and its owners, officers, employees, and agents (the "CarpoolQR Parties") are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, data, goodwill, or rides, arising from the Service or any meeting or ride between users.

You hereby release, waive, and forever discharge the CarpoolQR Parties from claims arising out of or related to interactions with other users, carpools, parking lots, or third-party services.

6. Indemnification

You agree to indemnify, defend, and hold harmless the CarpoolQR Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your content or messages; (d) any ride or meeting you arrange; or (e) your violation of any law or third-party rights.

7. Payments (CAD)

Paid features (Workplace Host monthly or 1-year, and an individual message pass for chat on one lot) may be offered through Apple Pay, Google Pay, or card payments. Prices are listed in Canadian dollars (CAD) unless stated otherwise. Applicable GST/HST/PST will be added when live charging is enabled, according to your province. CarpoolQR does not store full payment card numbers. Fees for Host and message-pass features are generally non-refundable once messaging access is granted, except where required by law (including consumer protection rules that cannot be waived).

8. Privacy of location data

Members share postal codes or ZIP codes for approximate area matching— not full residential street addresses. Lot creators may publish a full parking lot address. See our Privacy Policy (PIPEDA-minded for Canada).

9. User conduct

You will not: harass, threaten, or harm others; post illegal or abusive content; impersonate others; scrape or reverse engineer the Service; or use the Service for commercial transport without proper licensing where required.

10. Employers / workplace hosts

If you create a lot for a workplace, you represent that you are authorized to post that site information and QR materials. You remain solely responsible for workplace policies, labour rules, and parking arrangements. CarpoolQR is not your employer's agent.

11. Language

The Service is available in English and French. In Quebec, if a French version of a contract is required by law for a consumer contract, the French version will prevail for that purpose when both versions are provided. Demo content may be incomplete in translation.

12. Governing law (Canada)

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts of Alberta for disputes arising from the Service, except where mandatory consumer protection law requires otherwise in your province of residence.

13. Changes

We may update these Terms. Continued use after notice constitutes acceptance of the updated Terms where permitted by law.

CarpoolQR only helps people find and message each other about parking and possible carpools. CarpoolQR is not liable for anything that happens between users or on the road.
